By reserving a charter or using our Service, you consent to these Terms. Should you not agree with any section of these terms, you are not permitted to use the Service.

2. Service Overview

PineValleyView offers an array of premium yacht charter services, such as:

  • Daily yacht hire
  • Sunset voyages
  • Company retreats
  • Exclusive gatherings
  • Multiple-day charters

Service availability is contingent on many factors and may change. We retain the right to modify or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To confirm a charter reservation, you must:

  • Be no younger than 18 years old
  • Provide valid and full details
  • Fulfil the deposit payment as stated in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

Booking confirmation occurs only after we receive the payment and provide you with our written confirmation. We have the authority to decline service at our sole discretion.

3.3 Availability

Charter scheduling is subject to both vessel availability and acceptable weather conditions. We will try to honor your requested dates and timings where possible.

4. Payment Terms

4.1 Pricing

All fees are quoted in € and encompass applicable taxes unless stated otherwise. Pricings are subject to change at our discretion.

4.2 Payment Schedule

  • Deposit: 50% of the entire charter cost due upon booking
  • Remaining balance: Payable no later than 48 hours prior to charter departure
  • Additional expenses (if any): Payable after the charter concludes

4.3 Payment Methods

We accept most major credit cards, wire transfers, and certified cheques. Our payment processing is conducted through secured, encrypted channels.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Complete refund minus processing costs
  • 24-72 hours before departure: Refund of 50%
  • Less than 24 hours before departure: No refund will be given

5.2 Weather Cancellations

In case of unsafe weather as judged by our captain, options provided will be:

  • Reschedule to an alternative date without extra charges
  • Issue a full refund if rescheduling is impractical

5.3 Mechanical Issues

If your allocated vessel encounters mechanical issues, we will attempt to source an appropriate replacement. Should no substitution be available, we will issue a full repayment.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Heed all directions given by crew members
  • Utilize safety gear when mandated
  • Disclose any health conditions impacting their safety
  • Stay within the designated areas on the vessel

6.2 Prohibited Items

The items listed below are forbidden on board:

  • Glass containers
  • Illegal substances
  • Firearms or any forms of weapon
  • Excessive quantities of non-alcoholic beverages (beyond reasonable consumption)
  • Pets (except when allowed with prior approval)

6.3 Conduct

Visitors are expected to conduct themselves respectfully. Charters may be ended prematurely and without refund if a passenger's behavior endangers safety or disrupts others' experiences.

7. Liability and Insurance

7.1 Our Liability

Our financial responsibility is limited solely to the charter expense paid. We won't be held accountable for:

  • Injuries sustained due to a passenger's own neglect
  • The loss or harm of personal belongings
  • Indirect, consequential, or exemplary damages
  • Delays caused by weather or events outside of our influence

7.2 Insurance Coverage

Our comprehensive marine insurance safeguards both our vessels and operations. However, travelers should ensure they have their own travel and personal insurance.

7.3 Assumption of Risk

You recognize that maritime activities carry inherent hazards by choosing to partake in our charter services, and you accept responsibility for your own security and health.

8. Modifications and Itinerary Changes

We maintain the right to adjust itineraries, routes, or schedules due to weather, safety, or operational demands. We will attempt to offer alternatives of comparable value.

9. Force Majeure

We shall not be deemed responsible for delays, cancellations, or changes resulting from circumstances outside our authority, inclusive of but not constrained to:

  • Extreme weather phenomena
  • Natural disasters
  • Regulations by authorities
  • Port shutdowns
  • Vehicular malfunctions

10. Privacy and Data Protection

We handle your personal data according to our Privacy Policy. Engaging with our services signifies your acceptance of our data collection and usage as detailed in the Privacy Policy.

11. Intellectual Property

Our website content including texts, visuals, logos, and imagery is protected by copyright and trademark regulations. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without express permission.

These Terms are regulated by the laws of Germany. Any disputes will be settled within the jurisdiction of courts in Hamburg, Germany.
